Are you owed a refund of Power of Attorney registration fees? Tuesday 13th of February 2018

The Office of the Public Guardian (‘OPG’) has recently announced that over 1 million people have been overcharged over a 4 year period when registering Lasting Powers of Attorney or Enduring Powers of Attorney. 

During this period, the registration fees charged by the OPG were £110 per document.  However, as there were a greater volume of applications than in previous years and the process became more efficient, this resulted in fees being charged over and above the costs incurred by the OPG in processing the applications.  As a government agency, the fees charged should cover only operating costs unless legislation specifically gives them authority to do otherwise.  This overcharging was addressed on 1st April 2017 when the OPG reduced their fees from £110 to £82 per document.

If you paid to register a Power of Attorney between 1st April 2013 and 31st March 2017, you could be owed a refund of up to £54 (or £108 if you have registered both types of Lasting Power of Attorney).  The exact amount you can claim depends on when you paid for the Power of Attorney and whether you paid the full registration fee or the half-price fee (for those with an income of less than £12,000 a year or who are on certain benefits).
