Historically, the Courts in England and Wales would not always give effect to Pre-Nuptial Agreements or Post-Nuptial Agreements.

There has been a recent change due to the case of Radmacher v Granatino, in which the Court accepts that in certain circumstances, parties may agree to limit the extent of a financial settlement on divorce. This means that the Courts now give more weight to such agreements in the event of divorce.
