Law Society Unveils Updated Property Information Forms Effective 25th June

The Law Society has published a revised version of the TA6 Property Information Form (TA6), which will be mandatory for conveyancing transactions starting 25th June 2024. This form serves as a questionnaire for sellers to complete, providing buyers with essential information about the property.

The revised TA6, which has doubled in length, now consists of two parts:

  • Part 1 includes necessary details for estate agents to market a property, as well as information essential for the conveyancing process.
  • Part 2 raises supplemental questions that provide further information for the conveyancing process.

Estate Agents rarely use the TA6 form, which is produced and copyrighted by the Law Society. Consequently, sellers may find themselves needing to provide property information twice – once when the property is marketed for sale and again when the property is sold.

Some of the questions in Part 1 of the updated TA6 form may well be within the knowledge of the seller, such as details about the council tax band of the property and whether there is an electric vehicle charging point. However, other inquiries, such as whether there are any restrictive covenants affecting the property, may require assistance from a legal adviser. Therefore, sellers may need to involve their legal adviser earlier in the transaction than they currently do.

The updated form aims to provide buyers with comprehensive information upfront to minimise abortive sales and expedite the sales process.  Only time will tell whether this proves to be the case!
