Swinburne Maddison Helps Bring First Padel Facility To The North East

One of the region’s leading law firms has put the North East on the map with its behind-the-scenes legal work at Infinite Durham, a multi-activity park at Belmont Business Park on the outskirts of Durham city, which is to become home to the first indoor, dedicated padel facility in the North East – the fastest growing sport in the world. 

In getting the legal work required to complete the deal over the line, Durham-based Swinburne Maddison LLP undertook a range of legal matters on behalf of the managing director of the Infinite Durham complex, Austin Carney.

The area designated for the new Padel courts were in use as indoor football pitches located within the six-acre site at Infinite Durham.

Terms have now been agreed with an operator, True Padel Ltd, for a 15-year, full repairing and insuring lease covering an area of 32,579 sq ft. True Padel will convert the space into nine Padel courts with a café bar that will serve alcohol and refreshments.

Commenting on the deal, partner and head of the commercial property team, Victoria Walton, said:

Entrepreneur and businessman, Austin Carney, sees Soccarena almost as a second career after operating the highly successful betting chain, Reuben Page, which had 59 retail outlets before 44 were acquired by Gala Coral in 2007.  

Already an investor in Soccarena he jumped at the chance to take on the business fully when the opportunity presented itself in 2018, becoming the first person to get into multi-activity parks in the North East. He said:

The development of the Padel facility is a great fit with the environment we’ve tried to create at Soccarena – although it is the first activity where we won’t be both the owner and operator.

“My wife and I will continue to run the other facilities at Soccarena – Infinite Air, our very popular trampoline park, Infinite Tots, which is a soft play park with inflatables, Lickety Split, our award-winning ice cream parlour, and of course the outdoor football pitches, where we welcome the Russell Foster League each Saturday, Middlesbrough FC and Newcastle United to train their development youngsters, along with many junior clubs, at New Ferens Park.  

“So, if you include Padel into the mix, it is a really exciting addition. We have high hopes for its success.  It is a very popular sport throughout the world and has a growing following in the UK, but as yet, there are no facilities in this part of the world, so we are proud to be the first activity park to introduce it.”

Adam and Alex Carr of True Padel Ltd will be operating the new facility.  Adam said:  “We are delighted to have secured the space at such an established sporting location and are keen to get the new Padel facility open in early January 2024 – if all goes according to plan.”

Footwear company takes a big step for tiny feet with Durham law firm

Swinburne Maddison LLP, Durham City’s leading law firm, has assisted a Hong Kong-based children’s footwear company to take a big step forward in its business development by establishing a North East base at Meadowfield Industrial Estate.

Sea Way Footwear International (Sea Way) sells children’s footwear to major retailers including Next, Very and Sainsbury under the brand name Toezone.  The firm has signed a 999-year lease for 1500 sq ft of warehousing and office space, enabling it to operate its office and admin function upstairs while at ground floor level, its pick and pack warehouse and storage has been relocated to Meadowfield from a rented warehouse in London.

Sea Way was keen to fit out the new premises and begin trading as soon as possible so Swinburne Maddison pulled out the stops to conclude the legal work in only seven weeks. 

Commenting on the transaction, Gillian Moir, newly-appointed partner in Swinburne Maddison’s commercial property team, said:  “Swinburne Maddison was instructed in this matter due to a longstanding personal contact and it is the first transaction we have handled for Sea Way, so we are pleased to have completed the work so swiftly and to our client’s satisfaction.

Swinburne Maddison Assist Sustainable Materials Company’s Move To New Premises

Swinburne Maddison LLP, Durham City’s leading law firm, has concluded work in record time on a 10-year lease for sustainable materials company, Sphera, enabling its occupation of new premises at Seaham’s Jade Business Park.

From instruction, Swinburne Maddison quickly got work underway, taking just under eight weeks to complete the lease and associated documents.

Now fit out works are due to be carried out at the 11,195sq ft self-contained, semi-detached industrial unit, which will create a purpose-designed space to facilitate Sphera’s ambitious business development plans which include the launch of a new carbon negative, lightweight concrete aggregate, OSTO, which is poised to make a major impact within the built environment.

Commenting on the legal support provided by Swinburne Maddison, managing associate, Gillian Moir, who undertook the work, said:

“This lease was of a relatively high value and had to be turned around in a short time frame. I have significant experience of dealing with such matters and was able to conclude the legal work swiftly with assistance from the wider team.

“However, given the need to review title, undertake searches, review, negotiate and complete the documentation, such timeframes can often prove challenging when we do not have direct control over the response times of third parties in the process. In this particular matter, the landlord’s title to the estate was quite significant and a large number of documents were to be reviewed and reported on. Fortunately, all matters were concluded without a hitch.”

Sphera develops new materials for the built environment with no compromise to the planet and works with ambitious partners who are open to new science-led product innovations.

The company recently secured £1.9m funding to support its vision to be a world leader in low-carbon materials innovation. Over £75m CBILS Transactions for Atom Bank

Durham City’s leading law firm, Swinburne Maddison LLP (Swinburne Maddison) has announced its team completed over £75m of Coronavirus Business Interruption Loan Scheme (CBILS) transactions for Atom bank (Atom) between June 2020 and 31 August 2021.

A Government-backed scheme, CBILS was introduced as a lifeline to assist SME firms with a turnover of less than £45 million that had lost or experienced deferred revenues because of the impact of COVID-19.

Swinburne Maddison has been working with Atom since its formation and is a member of Atom’s legal panel for secured business lending.  One hundred and seven loans amounting to £75 million were transacted by Swinburne Maddison during the eight-month period, primarily by the commercial property team with the corporate team on hand to assist with any corporate and commercial elements of funding requests when required.

The volume of work was such that at the peak of demand, eight lawyers from across the firm were working  hard to make sure everything was delivered on time.

The Durham-headquartered Atom, established in 2014, was the UK’s first app-based bank and as such, instructions came to Swinburne Maddison from all over the UK throughout the pandemic, with loans ranging in value from £99,990 to £5 million. 

Nineteen loans were above £1 million and 47 were over £500,000, while a company in Bedford received the maximum loan available through CBILS of £5 million.  Firms in Bedford, Retford, Bridlington, Essex, London and Bristol requested sums between £3 million and £4.7 million and a Middlesbrough company received the seventh highest loan of £2.2 million.

In essence, Swinburne Maddison’s role was to perfect Atom’s security.  Dealing with various underwriters and their lending technical lead, Swinburne Maddison had to review the titles to any properties and carry out appropriate due diligence on any assets, as well as ensuring the correct documentation was completed so that Atom’s interests would be fully covered at all times, once the facility was in place.

Most of the legal work took place when businesses were still largely working under Covid restrictions, but due to the size and strength in depth across the firm, the CBILS operations team was able to rely on Swinburne Maddison’s wider team of lawyers and support staff to continue servicing the needs of other clients during this time.  

As partner and head of real estate, Victoria Walton, explains, they really didn’t take their foot off the gas for a moment:

“All deadlines were met, and the team worked extremely well. It was a superb team effort, which could not have been met without everyone’s support.  The work was extremely time pressured, particularly towards the end of the scheme when loans could not be re-sanctioned, and each transaction relied on significant volumes of documentation to be provided by those seeking funding, which was not always available until quite late in the transaction.  We were also very conscious that these loans represented a lifeline for many of the businesses we were dealing with, so there was an enormous amount of pressure on our team to coordinate everything in time to hit the completion dates and get the funding in place. 

“The volume of work did present some unique challenges, which on occasion, would undoubtedly have been easier to resolve had we all been working through these matters together in the same room.

“However, thanks to our tried and tested agile working programme and sound ICT infrastructure, with all case files being 100 per cent electronic, our team were able to work remotely without any difficulty and with full access to all the required information on a particular matter at a moment’s notice.

“In fact, this method of working was so successful that we have since developed our flexible working policy into a new ‘hybrid’ working policy, which will allow everyone at all levels of the firm to adopt an element of flexibility into their work.”

Commenting on Swinburne Maddison’s work, Atom Bank’s technical lending lead, Paul Jordan, said: 

“The support we got from Swinburne Maddison throughout the pandemic was great and we really appreciated the effort. It was an extremely busy time for us all.

“In August, after CBILS ended, we launched our Recovery Loan Scheme (RLS) product range after being accredited as an approved lender by the British Business Bank.  These loans are also designed to provide essential support to businesses in the wake of COVID-19 and replace CBILS, so we are delighted to be working with Swinburne Maddison again in transacting these loans.  We have an excellent working relationship with the Swinburne team.”

On May 1, the start of its new financial year, Swinburne Maddison undertook a reorganisation of its management team before embarking on an ambitious three-year expansion plan.  Since then, the business is reported to have continued to perform strongly and is comfortably on track to hit its growth targets with every department currently ahead of target.

Move to new premises marks start of further expansion for local Opticians

The Village Optician, a family run, local, independent Optician, founded in 2003 by Optometrist brothers Michael and Stephen Peart, is expanding with a move to new premises near the Arnison Centre, and has plans to recruit three new full-time members of staff.

This latest move marks another phase in the firm’s expansion since their first Opticians’ practice was established at Cobblers Hall, Newton Aycliffe 16 years ago.  There are now four shops spread throughout Durham and Darlington.

After outgrowing the premises on Alnwick Road, Newton Hall, The Village Optician has opened its new unit on Finchale Road, Newton Hall, next door to the new Bell’s Fish and Chip Restaurant.  

Providing legal assistance to support the move, Durham City’s leading law firm, Swinburne Maddison LLP (Swinburne Maddison), has come full circle after assisting some ten years ago when The Village Optician moved into its existing Newton Hall premises.

The law firm, which has acted for The Village Optician on all their leases, worked on the preparation of the new lease and a licence for alterations which has resulted in the customisation of the space with new signage, fixtures and fittings to accommodate a wider range of frames.

Law firm’s work gives The Bank a new lease of life

Durham City’s leading law firm, Swinburne Maddison LLP, has helped to pave the way for the old Lloyds Bank building on Derwent Street in Chopwell to embark on a new lease of life as an enterprise and welfare centre.

Following an instruction from Chopwell Regeneration CIO, the building’s new leasehold owners, Swinburne Maddison has completed the lease agreement enabling the next phase of the building’s life to get underway when it will be known as ‘The Bank’.

Construction began at the end of April, to strip out the building and completely refurbish it, turning it into a central place for the community to meet, take part in activities and access services and training.  The plans are for the building to become fully functional by October2021.

Gateshead Council, the building’s owner, has leased The Bank to Chopwell Regeneration Group for 35 years free of charge, so that it can be brought back into community use.

After standing empty for several years, £234,000 has already been raised by the community-based charity to make the building safe and usable and now they are fundraising for support with running costs when they open.

A warm and welcoming place to visit in the heart of Chopwell, The Bank will feature a community café open on Thursdays, Fridays and Saturdays together with employability training, mentoring and support for start-ups and small businesses.

There will also be rooms for small businesses and artists to rent, which will provide income to maintain the building with some hot desking facilities too, if permitted.

Swinburne Maddison is well known to the chair of the Chopwell Regeneration Group, Jodie Barwick-Bell, who has worked with them on several projects over the years.

Commenting on the project, Swinburne Maddison’s real estate partner, Victoria Walton, said:

Jodie Barwick-Bell, chair of the Chopwell Regeneration Group, said: “It is wonderful to see progress finally being made.  Since the mine closed in the 1960s, the village has been in decline and this facility will make an enormous difference to our community. 

“We have been working towards opening a building since the Chopwell Regeneration Group was formed by residents in 2017.  We have already undertaken several initiatives to set Chopwell on the road to a brighter future, such as developing a community orchard and a community allotment and brightening up the village with planting and Christmas lights, but we lacked a central base.  Now we have one and will be able to create jobs and opportunities in the heart of Chopwell.”

In 2018/19, Chopwell Regeneration Group undertook a feasibility study to consider alternative uses for some of the empty buildings in the village and as a result, Gateshead Council showed its support, bought the old Lloyds Bank building and agreed to lease it to the charity.

Jodie continued: “The Bank will be a game changer for our community. It will help meet immediate needs such as the significant food poverty in our rural community as we will be providing a ‘pay what you can’ café and a community fridge. At the same time, we will be providing opportunities for people to learn new skills and gain qualifications and providing a place for people to meet and take part in a wide range of activities and events.

“But the important thing is for local people to feel empowered to make change happen and, seeing construction work get underway, it is clear that this part of their journey has already begun – it is down to the support of so many people in our community that we are able to make The Bank a reality.”

Manufacturing Specialist Set to Expand Following Site Purchase

2020 is set to be a year of growth and expansion for automation engineering specialists Springfield NE Ltd after the company concluded 2019 by purchasing one of the units they currently occupy together with 2.4 acres of land.

Based at Chilton Industrial Estate in Chilton, County Durham, Springfield NE Ltd is a design and manufacturer of precision engineering products, offering a wide product portfolio of fabrication, jigs and fixtures, prototypes and batch samples for a range of assembly purposes, up to and including fully automated special purpose machines for customers throughout the UK and internationally.

The family-run business was established in 2005 by husband and wife, Colin and Marion Milsom and currently provides precision engineering solutions across several sectors including security and defence, automotive and medical.

Over the years, Colin and Marion have continued to invest in growing the business, with the purchase of eight state-of-the-art machines. They currently employ 18 highly skilled manufacturing staff across their three manufacturing facilities.

Assisted by Swinburne Maddison’s Kate Stephenson, Partner in the firm’s Real Estate team, the company has now purchased the freehold of the larger of the three units the business occupies.  The unit is situated on 2.4 acres of land and the recent purchase will enable the business to expand its manufacturing facilities by building an extension later in the year.

Historic multi-million-pound development of Lambton Estate now underway

Building on a relationship spanning several years, partner, Simon Robinson, at Durham City’s leading law firm, Swinburne Maddison LLP (Swinburne Maddison) is pleased to see the multi-million-pound development of Lambton Estate, near Bournmoor, Chester-le-Street, now finally underway.

Described as one of County Durham’s ‘hidden gems’ which had fallen into decline, the planning consent obtained for the development of part of the Lambton Estate some three years ago will see the renovation of the Grade II listed Lambton Castle, architect Ignatius Bonomi’s Lamb Bridge and castle stables and the construction of many new homes together with associated commercial and retail development. 

Over the last few years, Mr Robinson has played a major role in assembling the site for sale, acting on behalf of client, Theakston Estate Company Limited (Theakston) alongside the Trustees of Lambton Estate.

The construction work is now underway with development partner Miller Homes, who bid for and secured the first site to come to market, at the eastern entrance to Lambton Park.  Miller Homes will build 106 three, four and five-bedroom bespoke homes designed by Ben Pentreath and refined by POD architecture along with one, two and three-bedroom apartments.

As Mr Robinson, explains, this is the first phase to be developed, so it is extremely important that homes built here reflect the development team’s ambitious aspirations for the site, demonstrating both the heritage of the estate and the highest levels of quality and aesthetic appeal, because they set the tone for future phases.  He said:

“It is satisfying to see construction work now getting underway.  I worked on this project before I joined Swinburne Maddison, acting as legal adviser to Theakston at the time the option to purchase certain areas of land was taken up.  My instruction in this matter followed me to my new role and I have since negotiated several supplemental agreements and a Section 106 planning agreement.  My longstanding relationship with Theakston and my knowledge of the various projects has been particularly helpful.

“When drafting the legal documentation relating to the sale and other related matters, it has been necessary to work very closely with the Trustees of the Lambton Estate’s solicitors, Withers Worldwide LLP in London, together with the solicitors for Miller Homes Limited and GSC Grays, the managing agent acting on behalf of Lambton Estate.  Since it was necessary for all documentation to be approved at every stage and by all parties, this was both a complex and challenging process, with the overriding aim of keeping the transaction on track.”

Durham law firm assists leading automotive supplier with next phase in its development

With business continuing to go from strength to strength, one of the region’s leading suppliers to the automotive plastic and electronics industries has signed a further lease on a factory at Castleside Industrial Estate, Consett, as it seeks to consolidate its business operations.

Labone Castleside was assisted in this latest phase of its expansion by Gillian Moir, managing associate in the real estate team of leading Durham City law firm, Swinburne Maddison LLP (Swinburne Maddison).

With the additional lease for Factory 2, which provides a further 13,500 sq ft of space, Labone Castleside now occupies three units on the Castleside Industrial Estate, which collectively, provide over 89,000 sq ft for the further development of its plastic injection mouldings and assembly business.

Currently employing just under 200 people, Labone Castleside Ltd, which is owned by parent company R A Labone & Co of Ilkeston, is part of a diverse group of specialised manufacturing companies forming a global supply chain for major brands such as Daimler, Nissan, Jaguar Land Rover, Peugeot, BMW and Honda.

With turnover around £18m and plans to hit £21m by 2020, the ability to operate more efficiently from manufacturing sites in close proximity will move the company closer to achieving this goal, as Dawn Whittle, managing director of Labone Castleside explains:

“As demand for our services from current and new customers continued to grow, together with the capacity constraints we were facing, it became clear we needed more space, so with the support of the board further investment was approved to take up an additional lease for Factory 2, where we are occupying part of the old Grorud facility through Prospect Estates Limited.

“The global markets have played a part in all business sectors and continue to do so. As a business, we must closely monitor the impact of fluctuating sales because this affects our Just in Time (JIT) supply so it is very important that we have a flexible and supportive workforce to support the needs of the business and changes in customer demand. With more space at our disposal, we plan to increase the workforce by a further 24 people over the coming months.
