Who are we and what do we do?
Swinburne Maddison is a limited liability partnership, authorised and regulated by the Solicitors Regulation Authority under number 551177.
We collect, use and are responsible for certain personal data about you. When we do so we are subject to the UK General Data Protection Regulation (UK GDPR). We are also subject to the EU GDPR in relation to services we offer to individuals in the European Economic Area (EEA).
Our services and website are not aimed specifically at children, who are usually represented by their parents or guardians. If you are a child and want further information about how we might use your data, please contact us.

How and why we use personal data
Under data protection law, we can only use your personal data if we have a proper reason for doing so, e.g.:

- to fulfil our contract with you or take steps at your request before entering into a contract;
- for our legitimate interests or those of a third party; or
- where you have given consent – where we need your consent, we will ask for it separately of this privacy policy, and you can withdraw consent at any time.
A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests. We carry out an annual assessment when relying on legitimate interests, to balance our interests against your own. You have the right to object to processing based on legitimate interests. We must then stop the processing unless we can demonstrate compelling legitimate grounds which override your interests, rights and freedoms or the processing is required to establish, exercise or defend legal claims.

We may ask you to confirm or update your marketing preferences if you instruct us to provide further services in the future, or if there are changes in the law, regulation, or the structure of our business.
We will always treat your personal data with the utmost respect and never sell it to or share it with other organisations for marketing purposes.
Who we share your personal data with
We routinely share personal data with:
- professional advisers who we instruct on your behalf or refer you to, e.g. barristers, medical professionals, accountants, tax advisors or other experts;
- third parties where necessary to carry out your instructions, e.g. your mortgage provider or HM Land Registry in the case of a property transaction or Companies House;
- third parties we use to help deliver our services to you, e.g. providers of our case management and finance system, IT service providers, including cloud service providers such as data storage platforms and financial institutions in connection with invoicing and payments, such as Sage;
- Companies providing services for money laundering checks and other crime prevention purposes, and companies providing similar services, including financial institutions and credit reference agencies;
- our insurers and brokers;
- external auditors, e.g. in relation to Lexcel accreditation and the audit of our accounts;
- our bank.
We only allow those organisations to handle your personal data if we are satisfied they take appropriate measures to protect your personal data.
We or the third parties mentioned above may occasionally also share personal data with:
- our and their external auditors, eg in relation to the audit of our or their accounts, in which case the recipient of the information will be bound by confidentiality obligations
- our and their professional advisors (such as lawyers and other advisors), in which case the recipient of the information will be bound by confidentiality obligations
- law enforcement agencies, courts, tribunals and regulatory bodies to comply with our legal and regulatory obligations
- other parties that may acquire control or ownership of our business (and our or their professional advisers) in connection with a significant corporate transaction or restructuring, including a merger, acquisition or asset sale or in the event of our insolvency—usually, information will be anonymised but this may not always be possible and the recipient of any of your personal data will be bound by confidentiality obligations
Where your personal data is held
Information may be held at our office and those of our third party agencies, service providers, representatives and agents as described above (see ‘Who we share your personal data with’).
How long will your personal data be kept
We will not keep your personal data for longer than we need it for the purpose for which it was collected or as required by law.
We will not retain your data for longer than necessary. Different retention periods apply for different types of data. Please contact our Data Protection Officer for further details if required.
Following the end of the relevant retention period, we will delete or anonymise your personal data.
Transferring your personal data out of the UK
It is sometimes necessary for us to transfer your personal data to countries outside the UK, some of which may provide lower levels of protection of personal data.
We will transfer your personal data outside the UK only where:
- The UK Government has decided that the recipient country ensure an adequate level of protection of personal data (known as an “adequacy decision”) or
- there are appropriate safeguards in place, together with enforceable rights and effective legal remedies for you; or
- a specific exception applies under the relevant data protection law.
Where we transfer your personal data outside the UK, we do so on the basis of an adequacy regulation or (where this is not available) a legally approved standard data protection clause recognised or issued further to Article 46(2) of the UK GDPR. In the event we cannot or choose not to continue to rely on either of those mechanisms at any time, we will not transfer your personal data outside the UK unless we can do so on the basis of an alternative mechanism or exception provided by UK data protection law and reflected in an update to this policy.
Any changes to the destinations to which we send personal data or in the transfer mechanisms we rely on the transferring personal data internationally will be notified to you in accordance with the section on changes to this privacy policy below.
Use of Artificial Intelligence (AI)
We may use AI technologies to support and improve our services, such as customer support and data analysis. Any personal data processed by AI is handled securely and in line with data protection laws.
We do not sell or share personal data with AI providers for their own use. Where third-party AI tools are involved, we ensure appropriate safeguards and agreements are in place.

Keeping your personal data secure
We have appropriate technical and organisational measures to keep your data confidential and secure from unauthorised access, use and disclosure. We limit access to your personal data to those who have a genuine business need to access it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.
We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.
