Kaye Cunningham is an Associate Solicitor in Swinburne Maddison’s Dispute Resolution team, having been promoted to this role in May 2026. She specialises in housing litigation, advising social and private landlords on possession proceedings and evictions, anti-social behaviour cases, tenancy breaches, and public law challenges.
Qualifying in 2023, Kaye brings over 12 years of experience, having previously built a strong foundation as a County Court Advocate. During this time, she represented clients in urgent housing matters, including closure orders, housing disrepair claims and injunctions. Her advocacy background equips her with the ability to handle complex disputes strategically, anticipating challenges and preparing robust cases to place her clients in the strongest possible position.
Kaye has a particular passion for anti-social behaviour litigation, drawn to both its complexity and its real-world impact on communities. She enjoys analysing the finer details of the law and applying them in a practical way, helping clients navigate sensitive and often challenging situations.

Kaye has successfully represented clients in possession hearings, secured injunctions for social landlords, and defended against housing disrepair claims. Her experience in legal aid work has given her a deep understanding of how to counter and diminish claims effectively, helping clients prepare robust defences and identify the evidence needed to challenge opposing arguments.
In her day-to-day work, Kaye represents clients in possession hearings in the County Court, provides strategic legal advice on housing policies for social landlords, drafts pleadings, witness statements, claim forms, and particulars of claim, and manages ASB injunctions, gas and electrical injunctions, and tenancy succession cases. She regularly reviews evidence, including CCTV footage and witness statements, and advises on strategies to mitigate reputational risks for clients. Her strong advocacy skills allow her to adapt quickly in court and handle even the most contentious cases with confidence.
Beyond litigation, Kaye enjoys policy reviews and analysing statutory frameworks, ensuring her clients’ policies and procedures align with current legal standards. She finds intellectual challenge in case law interpretation and prides herself on being an expert in this field, offering clear, practical guidance in an often complex area of law.
